By accessing or using the ZameendarPk platform, you confirm your explicit understanding and acceptance of these Terms and Conditions. If you do not agree to these Terms and Conditions, you are prohibited from using our website, Android app, or iOS app.

ZameendarPk reserves the unequivocal right to modify, amend, add, or remove portions of these Terms and Conditions at any time. All changes will become effective immediately upon their posting on the ZameendarPk website, Android app, and iOS app, without any further notice being provided. We strongly advise you to regularly review these Terms and Conditions for updates. Your continued use of the ZameendarPk platform subsequent to the posting of any changes to these Terms and Conditions constitutes your binding acceptance of those changes.

USE OF THE ZAMEENDARPk PLATFORM

To use the ZameendarPk platform, you must be at least 18 years of age or be accessing the website, Android app, or iOS app under the direct supervision of a parent or legal guardian. We grant you a non-transferable, revocable, and limited license to use the ZameendarPk platform, in strict accordance with the Terms and Conditions outlined herein, solely for the purpose of purchasing personal items or utilizing services offered on the ZameendarPk platform. Any commercial use or use on behalf of any third party is expressly prohibited, unless prior written permission has been explicitly granted by us. Any breach of these Terms and Conditions will result in the immediate and automatic revocation of the license granted in this paragraph without any further notice to you.

The content and information provided on the ZameendarPk platform is intended solely for informational purposes. Product representations, descriptions, and opinions expressed on this platform are those of the respective vendors or individual users and do not necessarily reflect the opinions or endorsements of ZameendarPk.

Certain services and related features made available on the ZameendarPk platform may require user registration or subscription. Should you elect to register or subscribe for any such services or features, you agree to provide accurate, truthful, and current information about yourself, and to promptly update such information should any changes occur. Every user of the ZameendarPk platform is solely and fully responsible for maintaining the confidentiality and security of their passwords and other account identifiers. ZameendarPk shall not be held responsible or liable, directly or indirectly, for any loss or damage whatsoever incurred as a direct or indirect result of, or in connection with, your failure to adhere to the requirements of this section.

During the registration process, you acknowledge and agree to receive promotional emails from the ZameendarPk platform. You retain the right to opt-out of receiving such promotional emails at any time thereafter by simply replying with ‘unsubscribe’ in the subject line of any promotional communication.

USER SUBMISSIONS

Any content, material, or information that you submit to the ZameendarPk platform, and/or provide to us, including but not limited to, questions, reviews, comments, feedback, and suggestions (collectively, “Submissions”), shall become the sole and exclusive property of ZameendarPk and will not be returned to you. In addition to the rights applicable to any Submission, by posting comments or reviews to the ZameendarPk platform, you grant us an irrevocable, perpetual, worldwide, royalty-free, and sublicensable right to use the name or username that you submit in connection with such review, comment, or other content. You are expressly prohibited from using a false e-mail address, impersonating any other person or entity, or otherwise misleading us or third parties as to the true origin of any Submissions. ZameendarPk may, at its sole discretion, but shall not be obligated to, remove or edit any Submissions.

ORDER ACCEPTANCE AND PRICING

Please be advised that ZameendarPk reserves the right to refuse or cancel any order for any reason at any given time. There are various circumstances under which an order may not be processed. We may request additional verifications or information from you, including but not limited to your phone number and address, before we accept and process your order. ZameendarPk is committed to providing the most accurate pricing information on its website, Android app, and iOS app to our valued users. However, errors may occasionally occur, such as instances where the price of an item is not displayed correctly. In such cases, we unequivocally reserve the right to refuse or cancel any order. Should an item be mispriced, we may, at our sole discretion, either contact you for revised instructions or cancel your order and promptly notify you of such cancellation. ZameendarPk shall retain the right to refuse or cancel any such orders, irrespective of whether the order has been confirmed or if you have already been charged.

TRADEMARKS AND COPYRIGHTS

All intellectual property rights, whether registered or unregistered, pertaining to the ZameendarPk platform (including its website, Android app, and iOS app), the information and content presented on the platform, and the entire platform design (including, but not limited to, text, graphics, software, photos, video, music, sound, and their selection and arrangement), all software compilations, underlying source code, and all related software shall remain the exclusive property of ZameendarPk. The entire contents of the ZameendarPk platform are also protected by copyright as a collective work under Pakistan copyright laws and applicable international conventions. All rights are expressly reserved.

LEGAL DISPUTES

In the event that a dispute arises between you and ZameendarPk, our primary objective is to provide you with a neutral, efficient, and cost-effective means of resolving the dispute promptly. Accordingly, both you and ZameendarPk mutually agree that we will resolve any claim or controversy at law or equity that arises out of this Agreement or our services in strict accordance with one of the subsections below, or as we and you may otherwise mutually agree upon in writing. Prior to resorting to these formal alternatives, we strongly encourage you to first contact us directly to seek an amicable resolution. We will diligently consider all reasonable requests to resolve the dispute through alternative dispute resolution procedures, such as mediation or arbitration, as viable alternatives to formal litigation.

APPLICABLE LAW AND JURISDICTION

These Terms and Conditions shall be interpreted, construed, and governed exclusively by the laws in force in Pakistan. Subject to the Arbitration section provided below, each party hereby irrevocably agrees to submit to the exclusive jurisdiction of the courts of Karachi, Pakistan, and expressly waives any objections based upon venue or inconvenient forum.

ARBITRATION

Any controversy, claim, or dispute arising out of or relating to these Terms and Conditions, or the breach thereof, will be referred to and finally settled by private and confidential binding arbitration before a single arbitrator. The arbitration shall be held in Karachi, Pakistan, conducted in the English language, and governed by the laws of Pakistan pursuant to the Rules of Commercial Conciliation and Arbitration of 1994 (Dubai), as may be amended, replaced, or re-enacted from time to time. The designated arbitrator shall be a legally trained individual with substantial experience in the information technology field in Karachi, and who is fully independent of either party. Notwithstanding the foregoing, ZameendarPk expressly reserves the right to pursue the protection of its intellectual property rights and confidential information through injunctive relief or any other equitable remedies available through the courts of competent jurisdiction.
